A BILL to amend article two, chapter twenty of the code of West
Virginia, one thousand nine hundred thirty-one, as amended,
by adding thereto a new section, designated section
sixty-four, relating to wildlife resources; requiring
special use fishing permits for designated stream sections;
powers of the director; setting of fees; use of fees; and
providing that the special use permit is in addition to
other licenses and permits.
Be it enacted by the Legislature of West Virginia:
That article two, chapter twenty of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, be
amended by adding thereto a new section, designated section sixty-four, to read as follows:
ARTICLE 2. WILDLIFE RESOURCES.
§20-2-64. Special use permits for fishing designated stream
sections under special restoration management.
On and after the first day of January, one thousand nine
hundred ninety-seven, a special use permit is required to fish
within specified areas designated by the director of the division
of natural resources. The director shall designate any specified
area, specify the term of the special use permit and set the fee
for the special use permit for each specified area. The fee for
the special use permit may not exceed three dollars per day. The
director shall promulgate rules implementing this section in
accordance with article three, chapter twenty-nine-a of this
code. Funds obtained from the sale of special use permits shall
be used for purposes of funding special restoration management of
the designated specified areas. The special use permit required
by this section is in addition to any other licenses and permits
required by this article.
NOTE: The purpose of this bill is to require a special use
permit to fish within specified areas designated by the director
of the division of natural resources.
